California Re-implements Covid-19 Supplemental Paid Sick Leave and It Is Retroactive.
Effective February 19, 2022, and set to expire on September 30, 2022.
If an employee is unable to work or telework for any of the qualified reasons they will be eligible for 2022 COVID-19 Paid Sick Leave.
Covered employees in the public or private sectors who work for employers with 26 or more employees are entitled to up to 80 hours of 2022 COVID-19 related paid sick leave immediately upon an oral or written request to their employer.
40 of those hours are only available when an employee or family member tests positive for COVID-19.
Process Retroactive Requests
Employees may request (orally or in writing) and employers must provide retroactive payments to any employee who was on unpaid leave for a qualifying reason dating back to January 1.
This includes crediting back any PTO/Vacation/Other Sick Leave which may have been elected and applying for this COVID-19 Paid Sick Leave. and/or processing any true-up.
Retroactive payment shall be paid on or before the payday for the next full pay period after the oral or written request.
